Terms of Service for Yuccahub Africa WhatsApp Services

1. Acceptance of Terms

By opting in to receive messages from Yuccahub Africa via WhatsApp (official number: +254 7371 507), sending us a message, or otherwise interacting with our automated WhatsApp services, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws. If you do not agree with these Terms, do not opt in, interact with our service, or immediately reply "STOP", "QUIT", or "UNSUBSCRIBE" to cease receiving messages.

These Terms constitute a legally binding agreement between you ("User", "you") and Yuccahub Africa ("we", "us", "our").

2. Service Description

Yuccahub Africa provides automated WhatsApp messaging services powered by the WhatsApp Business API. These services include:

Messages are delivered via an automated cron-based system. The service is intended solely for informational and transactional purposes related to our software offerings.

3. User Consent and Opt-In/Opt-Out

Consent: By providing your phone number to us, initiating contact, or explicitly opting in (e.g., via keyword, form, or agreement), you consent to receive automated transactional and/or marketing messages from Yuccahub Africa on WhatsApp. You represent that you are the owner or authorized user of the phone number provided.

Opt-Out: You may opt out of receiving messages at any time by replying "STOP", "QUIT", "UNSUBSCRIBE", or similar keyword to our number. Upon receipt, we will send one final confirmation message, after which no further automated messages will be sent (except for any necessary transactional confirmations related to your opt-out). You may also block our number or report messages via WhatsApp. We honor all opt-out requests promptly in compliance with WhatsApp policies and applicable law.

To re-subscribe or resume receiving messages, you must explicitly opt in again.

4. Message Frequency, Timing, and Carrier Charges

Message frequency varies depending on your interactions, subscriptions, triggers, and service needs (e.g., one-time alerts, daily/weekly reminders, event-based notifications). We do not guarantee a fixed number of messages.

Carrier Charges: Standard messaging and data rates may apply as determined by your mobile network provider (e.g., Safaricom, Airtel, Telkom Kenya). You are solely responsible for any charges incurred from your carrier for receiving our messages. Yuccahub Africa is not liable for any such fees.

6. Limitation of Liability and Disclaimers

The service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of accuracy, reliability, merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, Yuccahub Africa, its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from:

Our total aggregate liability, if any, shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim, or KES 10,000, whichever is greater.

7. Changes to Terms

We may update or modify these Terms at any time. We will notify you of material changes by sending a WhatsApp message, posting on our website, or other reasonable means. Continued use of the service after such changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

8. Termination

We may suspend or terminate your access to the service at any time, without notice or liability, for any reason, including breach of these Terms, WhatsApp policy violations, or legal requirements.

You may terminate your participation by opting out as described in Section 3.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.

10. Compliance with Third-Party Policies

Your use of our WhatsApp services is also subject to Meta's WhatsApp Business Terms of Service, WhatsApp Business Messaging Policy, and other applicable WhatsApp policies (available at https://www.whatsapp.com/legal/business-terms and https://business.whatsapp.com/policy). In the event of any conflict between these Terms and WhatsApp's policies, WhatsApp's policies shall prevail to the extent of the conflict.
